PRIVACY, DATA GOVERNANCE & COMPLIANCE POLICY

1. LEGAL CAPACITY & IDENTITY VERIFICATION

By using Enrgy Flex, you explicitly authorise the collection and processing of:

• Government-Issued IDs: Digital copies of Passports, Driver's Licences, and National ID cards.
• Professional Credentials: RSA, White Cards, and ABN registration certificates.
• Biometric Metadata: Profile photographs used for identity cross-referencing.
• Right-to-Work Data: Visa grant numbers and Passport numbers for VEVO synchronisation.

2. INFRASTRUCTURE & ARCHITECTURAL SECURITY

Enrgy Flex operates on a High-Availability Cloud Framework hosted via Tier-1 global infrastructure providers.

• Encryption Standard: All sensitive identity files are stored using AES-256 bit encryption at rest.
• Network Security: All platform interactions are secured via TLS 1.3 protocols.
• Internal Access: Access to raw identity files is strictly "Least-Privilege" based and audited regularly.

3. MANDATORY VEVO & ABN CONSENT

This is a Compliance-First Marketplace. By uploading your details, you grant Enrgy Flex an irrevocable mandate to:

• Query Government Databases: Check your current visa status and work conditions via VEVO.
• Verify ABN Status: Confirm your status as an Independent Contractor via the Australian Business Register.
• Status Disclosure: Display your "Verified" or "Work-Ready" status to prospective Hosts.

4. LIMITATION OF LIABILITY & INDEMNITY

• No Employment Relationship: Enrgy Flex is a Technology Provider, not a labour-hire agency or employer.
• Identity Accuracy: Users are solely responsible for the authenticity of uploaded documents.
• Data Breach: While we implement enterprise-grade security, Enrgy Flex is not liable for unauthorised access resulting from User negligence.

5. THIRD-PARTY DATA FLOWS

• Financials: All payment processing is offloaded to Stripe. We do not store PCI-sensitive credit card data.
• Compliance: Identity data is shared with the Department of Home Affairs for visa validation.
• Legal Requests: We will disclose data only when legally compelled by Australian Law Enforcement or a Court Order.

6. DATA LIFECYCLE & DISPOSAL

• Active Retention: Records are maintained for the life of the account.
• Statutory Retention: Core transaction metadata and ABN records are retained for 7 years to comply with ATO and Fair Work regulations.
• Secure Purge: Upon expiration, files undergo Cryptographic Erasure, rendering them unrecoverable.
